The Board of Directors has called a special meeting of the members (homeowners) of the Association to make certain amendments to the Association’s Declaration of Covenants, Conditions, and Restrictions (the “Covenants”;). The meeting will be held at 7:30 p.m. on February 10, 2011, at the First Baptist Church of Laurel.
The Association’s bylaws require 30% of the members to attend this meeting (or submit a proxy) for the required vote to be held. Please make plans to attend this important meeting. All members who attend and who desire to speak on the proposed amendments may do so.
The Board of Directors proposes that the Association amend the following sections of the Covenants:
Sections 1.1, 5.2, 7.1, 7.4, 11.13, 12.2, and 12.7
These sections relate (or contain provisions relating to) the “Supplemental Town Home Lot Assessments.” These assessments are the annual on-lot maintenance assessment levied by the Association against each homeowner for the mowing and lawn maintenance services performed by the Association. When the Covenants were originally drafted, this assessment (and the related lawn care services) were only intended to apply to the town home lots. Before any homes were sold, however, the builders requested that the developer include the single-family homes in the on-lot maintenance program. All lots have been charged the assessment and received lawn care services since 2007. The Covenants were never updated to reflect this practice. The Board proposes to amend the Covenants to clarify that all lots are subject to this annual assessment and receive lawn care services.
Subsection 8.8(N)
This subsection relates to the installation of television aerial or radio antennae and satellite dishes. The provision in the Covenants do not comply with federal regulations issued by the Federal Communications Commission. The Board proposes to amend this subsection to comply with federal law and to require compliance with rules and regulations promulgated by the Board or the Covenants Committee for the installation of these devices.
Subsection 8.8(R)
This subsection prohibits the installation of clotheslines on any Lot. Effective October 1, 2010, Maryland law prohibits a homeowners association from forbidding the installation of clotheslines. The Board proposes to amend this subsection to comply with Maryland law and to require compliance with rules and regulations promulgated by the Board or the Covenants Committee for the installation of clotheslines.
